These General Terms and Conditions ("Terms of Service" or "Terms") apply to all offers, orders, and agreements between Thornfield & Co. (hereinafter referred to as "we", "us", or "our") and the consumer (hereinafter referred to as "you" or "your") through our website thornfieldandco.co.uk.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access the website or use any services.
Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.
Article 1 — Definitions
In these Terms of Service, the following definitions apply:
Cooling-off Period: The period during which you may exercise your right to cancel the contract without giving any reason, being 14 calendar days from the day on which you (or a third party nominated by you) acquire physical possession of the goods.
Consumer: A natural person who enters into a distance contract for purposes wholly or mainly outside their trade, business, craft, or profession.
Distance Contract: A contract concluded between us and you under an organised distance sales scheme without the simultaneous physical presence of both parties, using one or more means of distance communication up to and including the moment at which the contract is concluded.
Durable Medium: Any instrument which enables you or us to store information addressed personally to you in a way accessible for future reference for a period of time adequate for the purposes of the information, and which allows the unchanged reproduction of the information stored.
Right of Withdrawal: Your right, as a consumer, to cancel the distance contract within the cooling-off period.
Day: Calendar day.

Article 3 — Applicability
These Terms of Service apply to every offer made by us and to every distance contract concluded between us and you. The text of these Terms of Service will be made available to you before the distance contract is concluded. If this is not reasonably possible, we will indicate how you may inspect the Terms of Service at our premises and they will be sent to you free of charge as soon as possible upon request.
If the distance contract is concluded electronically, the text of these Terms of Service may, by way of derogation from the preceding paragraph and before the distance contract is concluded, be supplied to you electronically in such a way that you may easily store it on a durable medium. If this is not reasonably possible, we will indicate, before the distance contract is concluded, where the Terms of Service may be inspected electronically and that they will be sent to you free of charge, at your request, either electronically or otherwise.
Should one or more provisions of these Terms of Service be wholly or partially invalid or void at any time, the contract and these Terms shall otherwise remain in force, and the provision in question shall be replaced by a provision that approximates the original as closely as possible, to be agreed through mutual consultation.
Article 4 — The Offer
All offers are made without obligation, unless a period of validity is stated in the offer. We reserve the right to change and amend the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow you to make a proper assessment of the offer. Images accompanying products are a true representation of the products offered. Apparent mistakes or errors in the offer are not binding upon us.
All images, specifications, and data in the offer are indicative and cannot give rise to compensation or dissolution of the contract. We cannot guarantee that the colours displayed on your monitor will exactly match the actual colours of the products.
Each offer contains such information that it is clear to you what rights and obligations are attached to acceptance of the offer. This includes, where applicable:
- The price, inclusive of all taxes, customs duties, and import charges for deliveries within the United Kingdom — as further detailed in Article 15 (Shipping & Customs);
- Any shipping costs, where applicable (standard shipping is free on all UK orders);
- The manner in which the contract will be concluded and the actions required;
- Whether or not the right of withdrawal applies;
- The method of payment, delivery, and performance of the contract;
- The languages in which the contract may be concluded, in addition to English.
Article 5 — The Contract
The contract is concluded at the moment you accept the offer and fulfil the conditions laid down. If you accept the offer electronically, we will immediately confirm receipt of acceptance of the offer electronically. As long as we have not confirmed this acceptance, you may dissolve the contract.
If the contract is concluded electronically, we will take appropriate technical and organisational measures to secure the electronic transfer of data and to ensure a safe web environment. If you are able to pay electronically, we will observe appropriate security measures.
We may, within the legal framework, investigate whether you can meet your payment obligations, as well as all those facts and factors relevant to responsibly entering into the distance contract. If, on the basis of this investigation, we have good grounds not to enter into the contract, we are entitled to refuse an order or application, stating reasons, or to attach special conditions to its implementation.
Every contract is entered into under the suspensive condition that the products concerned are available in sufficient quantities.
Article 6 — Right of Withdrawal (Cooling-Off Period)
When purchasing products, you have the option of dissolving the contract without giving any reason for a period of 14 days. This cooling-off period commences on the day after you, or a third party nominated by you who is not the carrier, receive the product.
During the cooling-off period, you shall handle the product and its packaging with care. You shall only unpack or use the product to the extent necessary to assess whether you wish to keep the product. If you exercise your right of withdrawal, you shall return the product with all accessories supplied and — insofar as reasonably possible — in its original condition and packaging to us, in accordance with the reasonable and clear instructions provided by us.
If you wish to exercise your right of withdrawal, you must notify us within the 14-day cooling-off period. You must make this notification by email to info@thornfieldandco.co.uk. After you have notified us that you wish to exercise your right of withdrawal, you must return the product within 14 days. You must prove that the goods delivered were returned on time, for example by means of proof of postage.
If, at the end of the periods specified above, you have not indicated that you wish to exercise your right of withdrawal and have not returned the product to us, the purchase is final.
Article 7 — Costs of Withdrawal
If you exercise your right of withdrawal, the costs of returning the product shall be borne by you. If you have paid an amount, we will refund this amount as soon as possible, but no later than 14 days after the withdrawal. However, we may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.
We will refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Article 8 — Exclusion of the Right of Withdrawal
We may exclude your right of withdrawal for the following products, but only if we have clearly stated this in the offer, in good time prior to the conclusion of the contract:
- Products created according to your specifications, or clearly personalised;
- Products that, by reason of their nature, cannot be returned;
- Products liable to deteriorate or expire rapidly;
- Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
- Sealed audio or video recordings or computer software, the seal of which has been broken after delivery.
Article 9 — Price and Payment
The prices of the products and/or services offered will not be increased during the validity period stated in the offer, subject to changes in VAT rates (where applicable).
Price increases within 3 months of the conclusion of the contract shall only be permitted if they are the result of statutory regulations or provisions. Price increases after 3 months of the conclusion of the contract shall only be permitted if we have stipulated this and it is the result of statutory regulations or provisions, or if you have the right to terminate the contract as of the day on which the price increase takes effect.
Delivered Duty Paid (DDP): All prices displayed on our website are final and inclusive of all applicable taxes, customs duties, and import charges for deliveries within the United Kingdom. You will not be required to pay any additional fees upon delivery. This is further detailed in Article 15.
Payment must be made within 7 working days of the conclusion of the contract, unless otherwise agreed. You are obliged to report inaccuracies in payment data provided or stated to us without delay.
All prices are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors. In the event of printing and typesetting errors, we are not obliged to deliver the product at the erroneous price.
Article 10 — Conformity and Warranty
We guarantee that the products comply with the contract and the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations existing on the date the contract is concluded.
A guarantee provided by us, the manufacturer, or the importer does not affect the legal rights and claims that you, as a consumer, can enforce against us under the contract.
Any defects or incorrectly delivered products must be reported to us in writing within 14 days of delivery. Products must be returned in their original packaging and in new condition.
The warranty does not apply if:
- You have repaired and/or processed the delivered products yourself or had them repaired and/or processed by a third party;
- The delivered products have been exposed to abnormal conditions or have otherwise been handled carelessly or contrary to our instructions and/or those on the packaging;
- The defect is wholly or partly the result of regulations that the government has made or will make regarding the nature or quality of the materials used.
Article 11 — Delivery and Performance
We will take the greatest possible care when receiving and executing orders for products. The place of delivery is the address you have provided to us.
We will execute accepted orders with due speed, but no later than 30 days, unless a longer delivery period has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, you will be notified no later than 30 days after placing the order. In that case, you have the right to dissolve the contract at no cost and may be entitled to compensation.
Following dissolution in accordance with the preceding paragraph, we will refund the amount you have paid as soon as possible, but no later than 14 days after dissolution.
If delivery of an ordered product proves impossible, we will endeavour to provide a replacement article. At the latest upon delivery, it will be stated in a clear and comprehensible manner that a replacement article is being delivered. The right of withdrawal cannot be excluded for replacement articles. The cost of any return shipment shall be borne by us.
The risk of damage to and/or loss of products shall be borne by us until the moment of delivery to you or a representative nominated in advance and made known to us, unless expressly agreed otherwise.
Article 12 — Complaints Procedure
Complaints about the performance of the contract must be submitted to us in full and clearly described within a reasonable time after you have discovered the defects, and in any event within 7 days.
Complaints submitted to us will be answered within 14 days of receipt. If a complaint requires a foreseeably longer processing time, we will reply within 14 days with a notice of receipt and an indication of when you may expect a more detailed answer.
If a complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute resolution procedure.
A complaint does not suspend our obligations unless we indicate otherwise in writing.
If we consider a complaint to be well-founded, we will, at our discretion, either replace or repair the delivered products free of charge.
Article 13 — Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of, or inability to use, the Service or the products purchased through the Service.
Our total liability to you for any claim arising under these Terms or in relation to any product purchased shall be limited to the purchase price of the product giving rise to the claim.
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
Article 14 — Disputes and Governing Law
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction over any dispute arising under these Terms. Nothing in this clause shall affect your statutory rights as a consumer to bring proceedings in the courts of the country in which you are domiciled.
If any dispute cannot be resolved amicably, we encourage you to contact us first at info@thornfieldandco.co.uk. Both parties shall attempt to settle the dispute through mediation before resorting to litigation.
Article 15 — Shipping & Customs Information (DDP)
Our products are shipped directly from our fulfilment centre in Shenzhen, China. We partner with YunExpress for international shipping, with final delivery handled by Evri, Yodel, or Royal Mail within the United Kingdom.
Delivered Duty Paid (DDP): All prices displayed on our website are final and inclusive of all applicable taxes, customs duties, and import charges for deliveries within the United Kingdom. This means:
- You pay the price shown at checkout — no hidden fees or surprise charges upon delivery;
- All customs clearance is handled by our logistics partners on our behalf;
- You are not required to pay any additional import VAT, customs duties, or handling fees to receive your order.
